Privacy Policy

This Privacy Policy describes how SeaBird Solutions, LLC ("SeaBird", "we", "us", or "our") collects, uses, discloses, and retains personal information when you use SeaBird Budgeting, a standalone manual budgeting app not connected to any bank or financial institution. We are committed to protecting your privacy and handling your data responsibly.
By using the Service, you agree to this Privacy Policy and our Terms of Service. We will not make material changes to this Policy without providing an in‑product notice and obtaining your affirmative acknowledgment at next logon (see Section 13). Non‑material changes (formatting, clarifications) may be posted and become effective when posted.
- Account & Contact Data: Email address, first and last name.
- Budgeting Data You Enter: Ledger entries (date, category, credit/debit, vendor, total, notes), credit card details you input (company, limit, balance), vendor names, and calculator inputs/outputs (e.g., car loan, mortgage, savings). We treat budgeting data as sensitive within our systems.
- Consent & Audit Trail: Your acceptance of Terms/Privacy (checkbox status), timestamp, IP address, and immutable copies of the versioned Terms/Privacy you saw at acceptance.
- Usage & Device Data: IP address, browser/OS, device type, pages/features used (e.g., dashboards, insights), and diagnostics.
- Support & Communications: Messages you send us (including cancellation tickets) and related metadata.
We use essential cookies for authentication and security and analytics cookies to understand feature usage. You can manage preferences via your browser and our in‑app controls. Where required by law, we honor recognized universal opt‑out signals (e.g., Global Privacy Control) for sale/sharing and targeted advertising to the extent applicable (see Section 9). Disabling certain cookies may affect functionality.
- Provide and improve the Service (including calculators, dashboards, and insights).
- Authenticate you; prevent fraud, abuse, and security incidents.
- Create and maintain your consent/audit records.
- Respond to support requests and process cancellations.
- Comply with law; enforce our Terms; protect our rights and users.
- Analyze usage in aggregate to improve performance and reliability.
- Processors (Service Providers): Hosting, analytics, customer support, email delivery, and payment processing (e.g., Stripe). They must follow our instructions and use data only to provide services to us.
- Legal/Compliance: As required by law or to protect rights, safety, and property.
- Business Transactions: In a merger, acquisition, or sale of assets, subject to confidentiality and continued protection of this Policy.
- With Your Direction: If you ask us to share or export your data.
- No selling personal information. We do not sell personal information, and we do not “share” it for cross‑context behavioral advertising as those terms are defined under California law.
- No ads based on your budgeting data. We do not use your budgeting entries or calculator outputs for advertising.
- No hidden unilateral changes. We do not reserve a right to materially change this Policy without affirmative acknowledgment where required.
- No gag clauses. We do not restrict your lawful reviews or speech about us.
We use administrative, technical, and physical safeguards (e.g., encryption in transit, access controls, logging, tiered environments). No system is perfectly secure. You are responsible for safeguarding your credentials and any files you export from the Service.
- Account Data: For the life of your account and as needed for legal, tax, and audit obligations.
- Budgeting Data: While your account is active; you can export/delete subject to legal retention.
- Consent Records: Retained to evidence acceptance of Terms/Privacy and versions presented.
- Inactivity: Accounts without an active paid subscription and without login activity for 365 consecutive days are subject to termination and data deletion to the extent permitted by law (see ToS Section 22).
- Access/Portability: Request a copy of your data (including exports in CSV/Excel formats).
- Correction: Request corrections to inaccurate personal information.
- Deletion: Request deletion of personal information, subject to legal retention.
- Opt‑Out: Opt out of targeted advertising (if ever offered) and of certain analytics cookies; we also honor recognized universal opt‑out signals where required by law.
- Appeal: If we deny your request, you may appeal by replying to our decision email; we will inform you how to escalate to your regulator when required by law.
To exercise rights or choices, email support@seabird.biz. We will verify your request and respond within applicable timelines.
The Service is not intended for children under 13. We do not knowingly collect personal information from children. If we learn we have, we will delete it.
We process data in the United States and may use processors in other countries. Where required, we implement appropriate safeguards (e.g., Standard Contractual Clauses) for cross‑border transfers.
California (CCPA/CPRA): We do not sell or share personal information for cross‑context behavioral advertising. You have the rights to access, delete, correct, and limit certain uses, and to appeal denials. If our practices change, we will provide required “Do Not Sell or Share” mechanisms before any such activity.
Maryland (MODPA): Effective October 1, 2025 (with certain obligations applicable to processing after April 1, 2026), Maryland residents have rights similar to other state privacy laws, including the right to opt out of targeted advertising and certain profiling and to use recognized universal opt‑out signals. We will honor these rights as they come into effect.
Virginia/Colorado/Connecticut/Utah and others: We extend comparable rights to residents of these states consistent with applicable law.
For material updates, we will present a dialog at next logon with links to this Policy and require you to check a box indicating you have read, understand, and agree. When you accept, we store a timestamped record with your IP and the exact version of this Policy presented. New versions create new records; prior records are retained.

Note on federal rulemaking: In January 2025, the CFPB proposed a rule to prohibit certain contract terms (e.g., waivers of substantive legal rights, unilateral amendments, restraints on lawful speech). That proposal was withdrawn on May 15, 2025. Regardless, we align our practices with those consumer‑protective principles and applicable law.
